司法公信力遭遇的“柔性侵蚀”困境及破解思路——以系统思维为视角

“Flexible Erosion”Dilemma in Public Confidence in Justice and Its Solution——In the View of Systematic Thinking

司法公正是司法公信力评估体系中的核心指标。当前,司法裁判中形式主义倾向明显,呈现出事实查明过度依赖甚至曲解“法律真实”含义、司法演绎逻辑“碎片化”组装、裁判立场及文书说理“反常识化”倾向等特征,使得司法公正理念饱受质疑,司法公信力建设遭遇“柔性侵蚀”。在应然视角下,主张规范解释与价值判断有机融合的系统性裁判思维是抵御司法公信力被“柔性侵蚀”的有力武器。兼具整体性、发展性、动态性内涵特征的“系统司法观”,以全面、立体的系统观念为指导,在事实认定、司法推理与条文解释等纯粹法律规范判断的技术立场下,融入以价值判断为保障的司法验证体系是一种兼具技艺理性与公共理性的科学裁判方法。在实践应用层面,慎始如终的事实反刍与证伪求验、以整体性立场与动态化思维为基础的司法逻辑演绎,以及司法的社会引领与责任担当意识是“系统司法观”的主要内容。

Judicial fairness is the core indicator in the evaluation system of judicial credibility.At present,the tendency of formalism in judicial adjudication is relatively obvious,gradually showing the characteristics of over reliance on fact finding and even misinterpretation of the meaning of“legal truth”,“fragmentation”assembly of judicial deductive logic,the tendency of“abnormal recognition”of judicial positions and document reasoning.Judicial justice has been questioned,and the construction of judicial credibility has encountered the dilemma of“flexible erosion”.From the perspective of necessity,the system judgment thinking that advocates the integration of normative interpretation and value judgment is a powerful weapon to resist the“flexible erosion”of judicial credibility.The“systematic judicial view”,which has the characteristics of integrity,development and dynamic connotation,is a scientific judgment method with both technical rationality and public reason,which integrates the technical position of pure legal normative judgment such as fact finding,judicial reasoning and clause interpretation into the judicial verification system guaranteed by value judgment,guided by a comprehensive and three-dimensional system concept.At the practical application level,the main content of the“system judicial view”is the cautious and consistent rumination of facts and the verification of falsehood,the holistic stance and dynamic thinking of judicial logic deduction,as well as the social leadership and sense of responsibility of the judiciary.
