Discussion of Taowen Trademark in theWarring States Period

尝试对学术界普遍关注的“物勒工名”“物勒地名”与“商标”的关系进行探讨。结合战国时代制陶业器具生产史实,判断带陶文戳印的器物是否有商品属性。按照商标三要素,推断战国时期戳印商品上的“物勒工名”与“物勒地名”都可称为商标。本文为“物勒工名”与“商标”、“物勒地名”与“商标”的关系探讨提供一定参考,并通过“物勒工名”制度总结战国时期相关民主法制的进展情况。

This paper attempts to discuss the relationship between“Wule Gongming”,“Wule Diming”and“trademark”,which is widely concerned by the academic community.Combined with the historical facts of pottery production in the Warring States period,it is judged whether the objects stamped with pottery have commodity attributes.According to the three elements of the trademark,it is concluded that the“Wule Gongming”and“Wule Diming”on the stamped goods in the Warring States period can be called trademarks.This provides a certain reference for the discussion of the relationship between“Wule Gongming”and“trademark”,“Wule Diming”and“trademark”,and summarizes the progress of the relevant democratic and legal systems in the Warring States period through the“Wule Gongming”system.
