资格权赋能与宅基地立体化高效利用

The Effective and Spatial Use of Rural Homesteads Based on Endowing Power With The Qualification Right

为了促进“上楼并居”,可基于资格权赋予农民充分自主建房的权能。这既符合历史上中国式城乡地权运行的理论逻辑,也符合农村宅基地运行的现实逻辑。以集体组织分类规划宅基地为前提,细化资格权“选择性行使”的三种权能(自由选择、按规划选择和按指定选择),构建资格权“牺牲补偿”机制,以激励农民共享宅基地,支持农民“自主建房”和“共享建房”,稳慎引导农民“上楼并居”,促进宅基地的空间立体化有效利用以及宅基地所有权、资格权和使用权的充分实现。

In order to realize the qualification right and make effective use of the rural homesteads,it is necessary to endow the peasant household with the right of house building which is included in the qualification right of rural homesteads.Such endowment is in accordance with both the theoretical logic of Chinese urban rural land property rights’performance and the realistic logic of the rural homesteads’performance.The rural committee can classify the homesteads on the basis of such endowment.At the same time,the peasants can exercise the power of their qualification right selectively by three types.In order to utilize the homesteads stereoscopically,a mechanism of“sacrifice compensation”can be established,which can incite the peasants’act of sharing the same homestead and building their own houses by themselves with the help of the rural committee,and permit the peasants to be urbanized repeatedly.
