社会组织提起环境民事公益诉讼的实践困境与提升路径——以湖南省生态保护志愿服务联合会为例

The practical dilemma and promotion path of social organizations participating in environmental public interest litigation——A case study of Ecological Protection Federation of Hu'nan Province

在各方共同努力下,我国社会组织提起环境民事公益诉讼的司法实践已经取得了长足的发展。不少社会组织基本建成了环境民事公益诉讼专门化组织体系,广泛开展了环境民事公益诉讼,维护了公共环境利益,取得了良好社会效益。但普遍也面临着外部环境有待优化,内部建设亟需加强,制度安排必须完善等实践困境,需要通过优化社会组织提起环境民事公益诉讼的外部环境,加强社会组织提起环境民事公益诉讼的能力建设,完善环境民事公益诉讼的具体制度及配套机制等有效措施,进一步提升社会组织参与环境治理的法律能力,助力人与自然和谐共生的现代化宏伟目标的实现。

With the joint efforts of all parties,the judicial practice of Chinese social organizations to file environmental civil public interest litigation has made great development.Many social organizations have basically established a specialized organization system for environmental civil public interest litigation,carried out extensive environmental civil public interest litigation,protected public environmental interests,and achieved good social benefits.However,they are generally faced with practical dilemmas such as external environment to be optimized,internal construction to be strengthened,and institutional arrangements to be improved.Effective measures such as optimizing the external environment for social organizations to file environmental civil public interest litigation,strengthening the capacity building of social organizations to file environmental civil public interest litigation,and improving the specific system and supporting mechanism of environmental civil public interest litigation are needed.Further enhance the legal capacity of social organizations to participate in environmental governance,and help realize the modernization goal of harmonious coexistence between man and nature.
