公共体育场馆PPP合同核心要素研究——基于典型案例分析

A Study on the Core Elements of PPP Contracts of Public Gyms and Stadiums——Based on the Typical Cases Study

合同规范是体育场馆PPP项目可持续实施的基础。论文主要采用专家访谈法与案例分析法,对体育场馆典型PPP合同核心条款进行分析,梳理相关问题,进而提出相关建议。研究认为,典型合同核心条款基本符合规范,但还存在相应问题,建议依据合同标准,促进合同规范、合同机制多元化、优化绩效考核等,为体育场馆PPP合同规范提供思考。

The contract specification is the basis for the sustainable implementation of PPP projects of gyms and stadiums.Using the expert interview method and case analysis method,the paperanalyzes the core terms of typical PPP contracts of gyms and stadiums,sorts out relevant problems,and then puts forward some relevant suggestions.The results show thatthe core terms of typical contracts basically conform to the norms.But there still existsome corresponding problems.It is suggested to conform to the contract standards,promote contract norms,diversify contract mechanisms,optimize performance appraisal,etc.,to provide thinking for the PPP contract specification of gyms and stadiums.
