执纪执法指导性案例“应当参照”的效力证成及制度路径

The Validity and Institutional Path of Shall Refer in the Guiding Cases on Disciplinary Enforcement

执纪执法指导性案例是由中央纪委国家监委发布,各级纪检监察机关在办理同类问题时应当参照的执纪执法标准。执纪执法指导性案例在实践中被各级纪检监察机关参照,有利于实现执纪执法指导性案例制度及时贯彻落实中央决策精神、保证执纪执法标准明确统一、实现中央纪委国家监委对下业务指导、弥补执纪执规解释之缺位、促进党内法规的完善和修订的目的。但当前执纪执法指导性案例仅有基于纪检监察机关领导体制所形成的事实上的效力而无规范上的效力,这一效力定位可能导致其在纪检监察实践中遭到忽视。为使得执纪执法指导性案例对各级纪检监察机关产生约束力,应当以党内法规或规范性文件的制度形式赋予执纪执法指导性案例以类党内法规的规范效力。

The guiding cases on disciplinary enforcement are issued by the Central Commission for Discipline Inspection and State Supervision and should be referred to by the discipline inspection and supervision organs at all levels when handling similar issues.In practice,the guiding cases on disciplinary enforcement are referred to by discipline inspection and supervision organs at all levels,which is conducive to the timely implementation of the spirit of the central government's decisions,ensuring clear and uniform discipline enforcement standards,achieving operational guidance from the Central Commission for Discipline Inspection and State Supervision,making up for the lack of interpretation of discipline enforcement rules,and promoting the improvement and revision of Party regulations.However,the current guiding cases on disciplinary enforcement only have actual effect but not normative effect based on the leadership system of the discipline inspection and supervision organs,which may lead to their neglect in the practice of discipline inspection and supervision.In order to make the guiding cases on disciplinary enforcement binding on discipline inspection and supervision organs at all levels,the guiding cases on disciplinary enforcement should be given the normative effect of Party regulations in the form of Party regulations or normative documents.
