西藏边境贸易纠纷解决机制的创新探索

On the Mechanism Innovation of Settling the Disputes of Border Trade in Xizang

随着丝绸之路经济带的兴盛,西藏边境贸易纠纷的处理日显重要。西藏边境贸易纠纷类别多样,大额贸易纠纷不断增多,纠纷的解决方式日渐多元化。影响西藏边境贸易纠纷处理的因素主要有贸易立法不足、相关人员法律意识淡薄、贸易参与者的诚信缺失、相关管理或协调机制不够成熟等。目前可通过加快贸易立法、注重民族因素、健全纠纷解决路径及促进中外司法协作等举措,切实改进西藏边境贸易纠纷解决机制。

With the prosperity of the Silk Road Economic Zone,the disputes of border trade in Xizang increasingly can not be ignored.the disputes of border trade in Xizang had many categories and the large trade disputes kept coming.the diversification of dispute settlement mechanism developed.Factors which influenced the disputes of border trade in Xizang was lack of trade legislation,weak legal consciousness,lack of honesty and management or coordination mechanism was not mature.At present,we could speed up trade legislation,regard national factors,perfect dispute settlement path and promote judicial cooperation between China and foreign countries to improve the settlement mechanism of border trade disputes in Tibet.
