监狱监管和社区矫正“监管”的异质性分析

社区矫正机构和监狱同样监管罪犯,但二者的“监管”是不能等同的。从《监狱法》对刑罚执行权和其他权能的赋权形式看,监狱刑罚执行权具有单一专属性,监管本身就是执行刑罚活动;社区矫正的权力行使是多元分权制,社区矫正中的“监管”是行政管理权的体现。监狱监管是刑罚执行活动和狱政管理的有机结合;社区矫正的“监管”是对社会危险成员的管控活动。监狱监管的监管者和被监管者地位是不平等的,是惩罚与被惩罚的关系;社区矫正中的“监管”是管理与被管理的关系。监狱的监管是事前强制规范,坚持以全面干预为原则,以不干预为例外;社区矫正的“监管”是事后干预,坚持以不干预为原则,以干预为例外。
