“两法”实施背景下未成年人检察监督参与社会治理研究

Research on the Participation of Juvenile Prosecutorial Supervision in Social Governance under the Background of the Implementation of the"Two Laws"

在“两法”实施背景下,检察机关通过履行新法赋予的法定职责,以法律实施监督者的角色推进落实“两法”构建的工作格局和制度设计,是新时代未成年人检察监督参与社会治理、提升我国未成年人司法体系内涵和质量的重大使命。结合检察权属性、未成年人工作独特性和新法授权,未成年人检察监督参与社会治理具有司法保护、犯罪预防和案件处理三种形态,其实现路径也须通过法律实施的监督和法律赋权的拓展予以合理构建。

In the context of the implementation of the"Two Laws",the procuratorial organs,by fulflling the statutory responsibilities conferred by the new laws,promote the work pattern and system design of the construction of the"Two Laws"in the role of legal implementation supervisors.This is a major mission for the participation of minors in social governance and the improvement of the connotation and quality of China's juvenile justice system in the new era.Combining the attributes of prosecutorial power,the uniqueness of minors'work,and the authorization of new laws,the participation of minors'prosecutorial supervision in social governance has three forms:judicial protection,crime prevention,and case handling.Its implementation path must also be reasonably constructed through the supervision of legal implementation and the expansion of legal empowerment.
