网络时代著作人身权限制研究

数字技术加快了作品创作与传播的速率,也造就了网络环境中作品数量庞大的景象。然而,因为网络作品的数量庞大,作品的有效授权许可成为难题,而著作人身权更进一步加剧了许可困境。为了激活网络作品令其被有效利用,促进网络作品的顺利交易,增加公共利益,应该对网络著作人身权进行合理的限制,从作品的类型、作品的使用惯例以及交易的目的等方面对著作人身权进行适当限制。合理限制网络环境下的著作人身权有利于在维护作者正当利益的前提下促进作品的传播与利用,帮助实现作品的经济与文化价值,让网络环境从作品数量众多的现实进化为文化繁荣的胜景。

Network technology speeds up the creation and dissemination of works and creates a huge number of works in the network environment.However,due to the huge number of online works,the effective licensing of works has become a difficult problem,and the personal rights of copyright further exacerbates the licensing dilemma.In order to activate network works,make them effectively used,promote the smooth transaction of the network works and increase public interests,one should reasonably restrict the personal rights of the network works.The personal rights of copyright can be appropriately restricted from the types of works,the usage practices of works,and the purpose of the transaction.Reasonably restricting the personal rights of works under the network environment is conducive to promoting the dissemination and utilization of works on the premise of safeguarding the legitimate interests of authors,helping to realize the economic and cultural value of works,and making the network environment evolve from the reality of a large number of works to the scenery of cultural prosperity.
