大数据时代的到来冲击着传统的社会权力结构,从而也塑造着新兴的侦查模式形态。在侦查理念层面,侦查人员面临从传统的物质交换原理指导下的“由案到人”的被动模式向大数据时代下“由人到案”“由数据到案”主动模式转变。而在逻辑起点方面,网络世界拓展了“空间”的外延,将“空间”从物理领域拓展到“虚拟”空间,侦查活动的起点也从犯罪现场延伸至信息数据。在侦查路径层面,相较于传统侦查活动中偏赖于基于因果律思维的追溯型侦查,大数据时代下,侦查路径更是倾向于通过数据的“关联性”特性达到事前预防的最佳侦查效果。当下,侦查机关应当充分利用大数据、云计算等新技术优势,将传统侦查模式与大数据侦查模式相融合,精准打击刑事犯罪活动,切实提高侦查效率。

The arrival of the era of big data impacts the traditional social power structure and shapes the emerging investigation mode.At the level of investigation philosophy,investigators have changed from the passive mode of"from case to person"guided by the traditional material exchange principle to the active mode of"from person to case"and"from data to case"in the era of big data.In terms of logical starting point,the network world expands the extension of"space",extending"space"from the physical field to the"virtual"space,and the starting point of investigation activities extends from the crime scene to information data in the era of big data.At present,investigation organs should make full use of new technological advantages such as big data and cloud computing,integrate traditional investigation mode with big data investigation mode,accurately crack down on criminal activities,and effectively improve investigation efficiency.
