法治化营商环境的司法现状、问题与优化对策——基于“执行合同”第三方评估结果展开

The Judicial Situation,Problems and Optimization Countermeasures of Legalized Business Environment--based on the evaluation results of"execution of the contract"

司法环境是法治化营商环境最直观的外在呈现,世界银行营商环境评价的执行合同指标从诉讼效率、诉讼成本以及司法程序质量三个维度刻画出法治化营商环境的现实司法样态。从评估结果来看,纠纷解决时间较长、司法鉴定成本高昂以及法院信息化应用深度不足成为影响诉讼效率、诉讼成本和司法程序质量的共性问题。为营造高效、亲民、便民的法治化营商环境,达致当事人接近正义的司法目标,我国应当从推广约定送达地址制度、拓宽电子送达适用、强化鉴定时间把控、发挥非诉纠纷解决机制潜力、优化审判人员职能配置以及创新执行方式等方面多措并举提升诉讼效率,通过公益性司法鉴定收费模式改革降低诉讼成本,并不断推进“互联网+司法”的全面融合。

The judicial environment is the most intuitive external presentation of the legal business environment.The index of execution of the contract of the World Bank's business environment evaluation describe the realistic judicial pattern of the legalized business environment from three dimensions:litigation efficiency,litigation cost and judicial procedure quality.From the evaluation results,the relatively long dispute resolution time,the high cost of expert evidence and the insufficient depth of application of electronic court have become common problems hindering the optimization of litigation efficiency,litigation cost and judicial procedure quality.In order to create an efficient,people friendly and convenient legal business environment and achieve the judicial goal of bringing the parties close to justice,China should take multiple measures to improve the efficiency of litigation,including promoting the agreed delivery address system,expanding the application of electronic service,strengthening the control of identification time,giving play to the potential of the non litigation dispute resolution mechanism,optimizing the functional distribution of judicial personnel,and innovating the implementation methods,reduce litigation costs through the reform of the charging model of expert evidence,and continue to promote the deepening application of electronic court construction.
