我国自媒体“洗稿”行为侵权认定的检视与完善

目前,我国司法实践对图书作品“洗稿”行为的侵权认定普遍采用“接触+实质性相似”规则。在人工智能兴起的今天,媒体作品与传统的图书作品在呈现的方式、结构和内容等存在较大差别,对两种作品的“洗稿”手段也大有差异,不宜直接套用传统图书的“洗稿”侵权认定方法。基于目前自媒体“洗稿”行为的特殊性考量,对自媒体“洗稿”行为的侵权认定宜适用严格责任,在“接触+实质性相似”规则的基础上,采取整体测试结果和抽象测试结果并重或者提升后者比重,并引进专业鉴定意见、专家证人和公众陪审对“实质相似性”进行补充认定,同时发挥平台系统或者人工智能检测辅助来确定侵权行为,充分保障著作权人的合法权益。

At present,China's judicial practice generally adopts the rule of"contact+substantive similarity"to identify the infringement of"washing"of books and works.Especially in the context of the rise of artificial intelligence,there are great differences between media works and traditional book works in the way of presentation,structure and content,and there are also great differences in the means of"washing"the two kinds of works.It is not appropriate to directly apply the"washing"infringement identification method of traditional books.Based on the consideration of the particularity of the current we-media"manuscript washing"behavior,the infringement determination of we-media"manuscript washing"infringement should be based on the basic rule of"contact+substantive similarity",and the"substantial similarity"should be determined again by taking the overall test results and abstract test results,and the"substantial similarity"should be further determined by introducing professional expert opinions,expert witnesses and public jurors,At the same time,make full use of the platform detection data to determine the establishment of the infringement,so as to determine the infringement identification method that conforms to the particularity of We-media works,and ensure the full protection of the legitimate rights and interests of the copyright owner.
