美单边制裁背景下的企业反制裁情报服务体系建构研究

Research on the Construction of Enterprise Anti-Sanctions Intelligence Service System Under the Background of American Unilateral Sanctions

[研究目的]通过分析美国《防止强迫维吾尔族劳动法案》的立法进程及其影响,揭示美国对华单边制裁趋势,提出我国企业反制裁情报服务体系的建构意义及具体方案,以期为企业情报服务体系建设提供理论依据。[研究方法]采用文献分析、案例研究等方法,将竞争情报理论与企业反外国制裁实践相结合,对企业反制裁现状和问题、竞争情报理论和实践意义以及如何构建符合企业实际需求的反制裁情报服务体系进行递进式结构分析,提出企业反制裁情报服务体系的总体架构和运行机制。[研究结论]美单边制裁背景下的企业反制裁情报服务体系是政府引导、立法引领、企业协同的情报服务体系,应从需求层、服务层和外部环境层3个层面进行总体建构,并通过动力机制、控制协调机制、情报共享机制以及支持保障机制支撑体系运行。

[Research purpose]In order to provide a theoretical basis for the construction of the information service system of enterprises,this paper reveals the trend of the unilateral sanctions by the United States against China,reveals the significance of the construction of the enterprise anti-sanctions intelligence service system and proposes a concrete scheme for the system construction by analyzing the legislative process and influence of the Uyghur Forced Labor Prevention Act of the United States.[Research method]Using the methods of literature analysis and case study,this paper combines the theory of competitive intelligence with the practice of enterprise anti-foreign sanctions,conducts a progressive structural analysis on the status and problems of enterprise anti-sanctions,the theory and practical significance of competitive intelligence and how to build an anti-sanctions intelligence service system that meets the actual needs of enterprises,and puts forward the overall structure and operation mechanism of enterprise anti-sanctions intelligence service system.[Research conclusion]Under the background of unilateral sanctions,the enterprise anti-sanctions intelligence service system is guided by the government,led by legislation and coordinated by enterprises.We should construct the system from three levels:demand level,service level and external environment level,and support the operation of the system through dynamic mechanism,control coordination mechanism,information sharing mechanism and support guarantee mechanism.
