中英图书馆交存制度比较研究及启示

Comparative Study of Legal Deposit System in Chinese and British Libraries and Its Inspiration

通过研究分析英国图书馆交存制度的立法情况、相关交存主体、交存程序及实施细则、奖惩制度、保存和使用内容可以发现:与英国相比,在法律方面,我国图书馆交存工作的法治建设比较落后,没有单独成法;在相关交存主体方面,交存主体范围狭窄,未对非印刷型出版物进行清晰的规定,与相关交存主体缺乏互动;在交存细则及实施方面,只有强制交存,交存规定及细则零散且陈旧,样本交存份数及总数量明显高于英国;在交存工作权责利方面,主要强调交存主体的义务,以行政约束进行处罚。借鉴英国图书馆交存制度的经验,我国图书馆交存工作应从以下几方面进行改进:制定图书馆专门交存法;明确图书馆交存对象及范围,并配套相关的实施细则;探索建立图书馆交存工作奖惩机制;加强相关交存主体的良性互动;建立专门的图书馆非印刷型出版物交存研究机构;分阶段实施非印刷型出版物交存。

Through the research and analysis of the legislation,relevant legal deposit subjects,procedures and implementation rules,reward and punishment system,preservation and use of the legal deposit system in British libraries,we can find that:compared with the United Kingdom,the legal system construction of legal deposit work in Chinese libraries is relatively backward,and there is no separate law.In terms of relevant legal deposit subjects,the scope of legal deposit subjects is narrow,there is no clear regulation for non printed publications,and there is a lack of interaction with relevant legal deposit subjects.In terms of the legal deposit rules and implementation,there is only mandatory legal deposit.The legal deposit rules and regulations are scattered and outdated,and the sample number and the total number are significantly higher than that of the United Kingdom.In terms of the rights,responsibilities and interests of the legal deposit work,it mainly emphasizes the obligations of the legal deposit subject,and punishes with administrative constraints.Drawing lessons from the experience of the legal deposit system in British libraries,the legal deposit work in Chinese libraries should be improved from the following aspects:formulating the special legal deposit law of libraries;specifying the legal deposit objects and scope of library,and providing relevant implementation rules;exploring the establishment of the reward and punishment system for the legal deposit work of libraries;strengthening the positive interaction with relevant legal depository subjects;establishing a special research institution for the legal deposit of non printed publications in the library;implementing the legal deposit of non printed publications in stages.
