新加密技术赋能下涉密载体的监管挑战与应对

摘要 为保障新加密技术不断发展过程中涉密载体的安全,利用文献分析法,聚焦各种新加密技术的特点,并对已有实践经验进行总结。发现涉密载体受新加密技术影响主要呈现出信息传输技术、数据保护要求、监管模式三方面的转变,存在监管标准不一、监管滞后、中央监管权力弱化以及刑事立法欠缺等问题。因此,统一监管标准、建立预判机制和应变机制、加强刑事立法等措施有助于有效应对出现的监管挑战。 In order to ensure the security of secret vector in the process of the continuous development of new encryption technology,this paper focuses on the characteristics of various new encryption technologies by using the method of literature analysis,and summarizes the existing practical experience.It is found that the influence of the new encryption technology in secret vector mainly shows the changes in information transmission technology,data protection requirements and supervision mode,and there are some problems such as different supervision standards,lagging supervision,weakening central supervision power and lack of criminal legislation.Thus,measures such as unifying supervision standards,establishing pre-judgment mechanism and contingency mechanism,and strengthening criminal legislation are helpful to effectively deal with the emerging supervision challenges.
