围产儿死亡之医疗损害责任纠纷案的实证分析

Empirical Analysis of Medical Damage Liability Dispute Cases in Perinatal Death

分析我国有关围产儿死亡之医疗纠纷案的年份、地区、医院等级、医院过错参与度分级、母婴结局、产生纠纷原因、赔偿金额等,发现案件多集中分布于东部地区、三级医院,赔付率高,产生医疗纠纷的原因复杂,医院过错参与度分级、母婴结局与实际赔偿金额成正比;多元线性回归分析结果显示年份、医院过错参与度分级、母婴结局、主张赔偿金额是影响实际赔偿金额的关键因素;由此探讨原因,并提出关于法律意识、围产期保健管理、技术水平、服务质量等方面的思考与建议。

After analyzing the case year,region,hospital grade,hospital fault participation classification,mater⁃nal and infant outcomes,causes of disputes,and compensation amount of medical dispute cases related to perinatal death,it is found that the cases were mostly concentrated in tertiary hospitals of eastern regions with high payout rates,complex causes of medical disputes,and hospital fault participation classification and maternal and infant out⁃comes are positively proportional to the actual compensation amount.The results of the multiple linear regression analysis show that the year,hospital fault participation classification,maternal and infant outcomes,and the amount of compensation claimed are the key factors affecting the actual compensation amount.The reasons are explored on this basis,and thoughts and suggestions are put forward on legal awareness,perinatal health care management,tech⁃nical level and service quality.
