论生态环境损害赔偿司法确认制度的构建

Construction of Judicial Confirmation System of Compensation for Ecological Environmental Damage

现有制度体系下,生态环境损害赔偿磋商协议的执行保障依靠民事司法确认制度。生态环境利益的公益属性与民事权益的私益属性形成强烈反差,民事司法确认制度建构以私益为基础,难以满足生态环境利益救济的需要,基于现实需求,生态环境损害赔偿司法确认制度亟待建立。在制度构建过程中,要明确生态环境损害赔偿司法确认制度与民事司法确认制度的差异,把握住生态环境利益的公益属性,将更好地实现受损生态环境利益的救济作为根本追求,以专业性为依托,从申请方式、管辖法院等五个维度完成制度核心的构建,进而保证受损生态环境利益救济的质量与效率。

Under the existing institutional system,the implementation and guarantee of the consultation agreement on ecological and environmental damage compensation rely on the civil judicial confirmation system.There is a strong contrast between the public welfare attribute of ecological environmental benefits and the private interest attribute of civil rights.The construction of civil judicial confirmation system is based on private interests,which is difficult to meet the needs of ecological environmental benefits relief.Based on practical needs,the judicial confirmation system for ecological environmental damage compensation urgently needs to be established.In the process of institutional construction,it is necessary to clarify the differences between the judicial confirmation system for ecological environment damage compensation and the civil judicial confirmation system,grasp the public welfare attribute of ecological environment interests,and take better relief of damaged ecological environment interests as the fundamental pursuit.Based on professionalism,the core of the system should be constructed from five dimensions such as application methods and jurisdiction courts,in order to ensure the quality and efficiency of relief for damaged ecological environment interests.
