New Paths for Legal Supervision on Sentence Reductions in the Context of Substantive Court Hearings

《关于加强减刑、假释案件实质化审理的意见》的出台,为减刑、假释案件实质化审理提供了具体的方向指引。减刑案件实质化审理的基本要求主要包括坚持全面依法审查、坚持主客观改造表现并重、坚持严格审查证据材料以及坚持区别对待。检察系统减刑监督工作已经取得了诸多成果,但是目前仍存在传统减刑、假释计算缺少必要的流程指引与刚性约束、同步检察监督机制运行不顺畅、减刑方法审查重心倒挂、监督形式化等困境。因此,要通过构建大数据减刑异常监督体系、减刑异常法律监督模型监测要素、落实多部门可视化即时监督等手段,不断探索实质化审理背景下减刑监督新路径。

The"Guidelines for Court Hearings in Sentence Reductions and Parole Cases"provided specific guidance for the substantive court hearings in sentence reductions and parole cases.The basic requirements include adhering to comprehensive review in accordance with the law,taking into consideration of convicts'rehabilitation performance from both subjective and objective aspects,strictly examining the evidence materials,and adopting differentiated treatment to the convicts.The procuratorial system's supervision on sentence reductions has achieved considerable success,but there are still many challenges,including the lack of necessary procedural guidance and rigid constraints on traditional calculation of sentence reduction and parole,the hindered operation of synchronized supervisory mechanisms,a disproportionate focus on methods and reviews in sentence reductions,and the formalization of supervision.Therefore,this article proposes the necessity of building a big-data system for monitoring anomalies in sentence reductions,clarifying the elements of the legal supervision model for anomalies in sentence reductions,and implementing visualized and real-time supervision by multiple departments,in order to continuously explore new legal supervision paths on sentence reductions in the context of substantive court hearings.
