科研经费领域反腐败中宽严相济刑事政策的贯彻问题

科研经费领域反腐败中应当认真贯彻落实宽严相济刑事政策。贯彻宽严相济刑事政策中“宽”的一面,应当对套取挪用科研经费案件尽量予以出罪处理,能不定罪处罚就不定罪处罚;即使对于涉案科研人员必须定罪处罚,也要尽量采取非监禁刑;即使必须适用监禁刑,在执行过程中也应积极运用减刑、假释、赦免制度,使科研人员尽快回归社会。贯彻宽严相济刑事政策中“严”的一面,应当对通过行贿获得科研经费的行为、科研管理人员受贿、滥用职权或玩忽职守等行为从严惩处。从根本上治理科研经费领域的腐败犯罪问题,必须从完善报销程序、改进科研人员劳动补偿机制等方面入手,进一步改革完善我国的科研经费管理体制。

The criminal policy of combining leniency with strictness should be conscientiously implemented in the anti⁃corruption in the field of scientific research funding.To implement the"leniency"aspect of the criminal policy of combining leniency with strictness,cases of misappropriation of scientific research funds should be dealt with as much as possible,and no conviction or punishment should be imposed if possible;even if the scientific research personnel involved must be convicted and punished,non⁃custodial sentences should be adopted as far as possible;Even if the sentence of imprisonment must be applied,the system of commutation and parole should be actively used in the implementation process,so that scientific researchers can return to society as soon as possible.To implement the"strictness"aspect of the criminal policy of combining leniency with strictness,the act of obtaining scientific research funding through bribery,scientific research management personnel accepting bribes,abuse of power or dereliction of duty should be severely punished.To fundamentally control the crime of corruption in the field of scientific research funding,we must start from improving reimbursement procedures and improving the labor compensation mechanism for scientific researchers,and further reform and improve China′s scientific research funding management system.
