“混合性党规”的法治问题及其解决对策

The Problems and Solutions of the Rule of Law in“Hybrid Party Rules”

混合性党规作为中国共产党和国家机关联合制定的法治规范,是中国法治的特色与优势所在,体现了党的领导与依法治国的有机统一。然而,混合性党规与纯粹的党内法规和国家法律存在天然的差异,无法与传统党规或国法的理论体系和制度实践机制完美契合。理论的欠缺与制度运行瑕疵为混合性党规的制定与实施埋下诸多隐患。平息混合性党规的属性争议、合理分配混合性党规的立规权限、建立健全混合性党规的审查监督机制等,成为当前实现混合性党规法治化、规范化的必由之路。

As the regulations made by Party organizations and state organs,hybrid Party rules are the characteristics and advantages of the rule of law in China,which embodies the organic unity of the Party’s leadership and the rule of law.However,there are essential differences between the hybrid Party rules,intra-Party regulations and national laws.Hybrid Party rules can not serve the traditional party rules or national laws perfectly.The deficiency of the theory and the defect of the system operation have laid many potential dangers for the formulation and implementation of the hybrid Party regulations.In order to achieve the standardization of hybrid Party regulations,it is necessary to settle the property disputes,reasonably distribute the authority,and build a sound review and supervision mechanism for mixed Party rules.
