世行营商环境报告法律问题研究——兼论中国商法的回应之道

世界银行营商环境报告深深地影响着一经济体法律制度的变革,其原理来自于法律与经济发展之间的可计算性,但其倡导的减少政府干预、不同层次规范性文件统一评价等评估体系,客观上简化了影响经济发展的因素。尽管良好的法律制度对一国经济发展有着重要作用,但经济发展这一事实并不必然能够推出法律制度良好的结论,因为忽视了政府行为、国际关系等其他因素的作用。在无法控制其他变量的前提下,世界银行进行营商环境评估,很大程度上会导致数据收集和评价结论的失真。我国商法在面对营商环境评估报告时,一方面应摒弃全是或全否的片面性回应,另一方面应立足本土法文化、法传统,积极与评估指标互动,关注法律制度修订后对营商环境优化的效果,以此来提高营商环境评估的科学性。

The World Bank’s business environment assessment report has a profound impact on the reform of an economy’s legal system.It’s principle comes from the calculability between law and economic development,but it advocates reducing government intervention and unified evaluation of regulatory documents at different levels.The evaluation system objectively simplifies the factors that affect economic development.Although a good legal system plays an important role in the economy development,the facts of economic development do not necessarily lead to a conclusion that a good legal system can be concluded,because it ignores the role of government actions,international relations and other factors.Under the premise that other variables cannot be controlled,the World Bank’s business environment assessment will largely lead to the mistakes of data collection and evaluation conclusions.When facing the business environment assessment report,the commercial law of our country should abandon all-or-no-one-sided responses on the one hand,and on the other hand,it should be based on the local legal culture and legal traditions,actively interact with the assessment indicators,and pay attention to the impacts of the legal system revision.The effect of optimizing the business environment is used to improve the scientific nature of the business environment assessment.
