乡村振兴背景下人民法庭参与诉源治理的困境与出路

The Dilemma and Way out of the People’s Court’s Participation in the Governance of the Source of Litigation in the Context of Rural Revitalization

随着乡村矛盾纠纷主体的多元化、利益诉求的复杂化、纠纷类型的多样化,人民法庭作为乡村治理体系中的重要治理主体,仅通过诉讼手段解决矛盾纠纷是不够的,必须认识到在乡村振兴背景下,人民法庭参与诉源治理的必要性。本文对人民法庭在参与乡村诉源治理工作中面临的诸如员额法官短缺、职能重心偏离、非诉事务能力减弱等困境进行梳理分析,在此基础上提出了推进诉调对接、优化非诉职能、建立联动机制等对策建议。

With the diversification of the subjects of rural conflicts and disputes,the complexity of interest demands,and the diversity of dispute types,the people’s court,as an important governance body in the rural governance system,is not enough to solve conflicts and disputes only through litigation,and must recognize the necessity of the people’s court’s participation in the governance of the source of litigation in the context of rural revitalization.In this paper,the people’s court in the participation of rural source of governance in the shortage of judges,the function of the focus of deviation,non-litigation matters such as weakened ability to sort out and analyze the dilemma,based on this proposed to promote the docking,optimization of non-litigation functions,the establishment of linkage mechanism and other measures to crack.
