摘要
类案检索机制旨在通过为待决案件提供审判指引与参照,从而统一裁判标准,也是为了解决司法实践过程中法律适用不明、裁判尺度不一,从而引发的对于“同案不同判”质疑的问题。从地区化到区域化的转向是法治发展的必然趋势,是兼顾法制统一与地方特色之重大举措,是由点及面的实现法治中国建设之具体路径。而在类案检索机制的运行过程中,出现了类案识别标准不一致性以及类案检索结果适用效力模糊性的现实困境。为了实现类案检索制度的规范化,需要明确类案识别的标准,并从类案检索机制的适用范围、实施路径和效力保障层面进行针对性的制度建设,实现制度功能最大化,为区域协调发展的法治化建设提供重要的制度机制支撑。
The similar case retrieval mechanism aims to unify adjudicationstandards by providing adjudication guidance and reference for pendingcases.It is also to solve the problem of‘different adjudication for thesame case’caused by the unclear application of law and differentadjudication scales in judicial practice.The shift from localization toregionalization is an inevitable trend in the development of the rule oflaw,a major measure that takes into account the unity of the legal systemand local characteristics,and a speciff c path to realize the construction ofthe rule of law in China from point to point.During the operation of thesimilar case retrieval mechanism,the practical dilemma of inconsistencyin the identiff cation standards of similar cases and the ambiguity of theapplicable validity of similar case retrieval results appeared.In orderto realize the standardization of the similar case retrieval system,it isnecessary to clarify the criteria for the identiff cation of similar cases andto carry out targeted system construction from the scope of application,implementation path,and effectiveness guarantee of the similar caseretrieval mechanism to maximize the system functions.As a result,it mayprovide important institutional support for the construction of the rule oflaw of coordinated regional development.
