随着科技的发展,人工智能在艺术构思、艺术传达、艺术传播、接受与评价等方面赋能艺术,为艺术创作带来了越来越多的可能性。但由于人工智能艺术的独创性存在争议,著作权法中的智力活动和智力成果是否涵盖人工智能艺术尚不明晰,使得人工智能赋能艺术存在法律风险。我国的司法实践中,侧重通过审视艺术创作过程中独创性来源对人工智能艺术进行法律规制。

With the development of science and technology,artificial intelligence plays significant role in areas such as artistic conception,expression,dissemination,acceptance,and evaluation,bringing more and more possibilities to artistic creation.However,due to the controversy over the originality of AI art,there is a vague space in the copyright law regarding whether intellectual activities and achievements cover AI art.This poses legal risks to the use of AI devices in the artistic creation.In the judicial practice in China,the legal regulation of AI art gives priority to the sources of originality in the process of artistic creation.
