我国生态环保督察的法律规制研究

Research on the Legal Regulation of Ecological and Environmental Protection Supervision in China

生态环境保护督察制度作为我国生态文明建设的重要举措,有效促进了我国环境治理领域的制度创新,对提升环境质量具有重要作用。但在实施过程中出现了法律依据不健全、环保长效机制欠缺和公众参与机制不健全等问题。通过借鉴域外的部分经验,我国生态环境保护督察要确保在中央的统一领导下,同时发挥地方环境治理的积极性,实现我国环境监管的现代化转变。本文从法律依据的健全、建立环境保护长效机制、对环境财权与事权进行合理划分、完善公众参与机制等方面对我国生态环保督察进行理性思考,试图进一步丰富我国生态环保督察的理论与实践。

As an important measure for China's ecological civilization construction,the ecological environmental protection supervision system has effectively promoted institutional innovation in the field of environmental governance in China and played an important role in improving environmental quality.However,in the process of implementation,problems such as imperfect legal basis,lack of long-term environmental protection mechanism and imperfect public participation mechanism have emerged.By drawing on some experiences outside the region,China's ecological and environmental protection inspectors should ensure that under the unified leadership of the central government,at the same time give full play to the enthusiasm of local environmental governance,and realize the modernization of China's environmental supervision.Rational thinking on China's ecological and environmental protection inspectorate from the aspects of sound legal basis,establishment of a long-term mechanism for environmental protection,reasonable division of environmental property rights and power rights,and improvement of public participation mechanism,etc.,in an attempt to further enrich the theory and practice of China's ecological and environmental protection inspection.
