智能网联汽车数据安全的风险、冲突与规制:基于总体国家安全观的规范建构

Risks,Conflicts,and Regulation of Data Security of Intelligent Connected Vehicle:Normative Construction Based on a Holistic Approach to National Security

智能网联汽车数据安全关系着社会整体安全秩序和产业发展前景,在制度治理的语境下面临个人、公共和国家的三重安全风险。风险背后是数据安全与数据利用两种价值之间的张力,二者的统一和冲突构成了贯穿智能网联汽车规范系统的主线,而价值把控的失衡与缺漏又频繁反映在其中。数据安全不同于传统安全的风险属性决定了两种价值存在统一的可能性。从总体国家安全观视角出发,对数据安全的中心宗旨和基本面向进行规范性建构,可以提炼出“人民安全”的价值衡量底线、与发展水平相适应的价值衡量标准以及与冲突重点相适应的价值衡量方法三种平衡价值冲突、实现数据安全有效利用的现实进路。

The data security of Intelligent Connected Vehicle(ICV)is related to the overall safety of society and industrial prospects.In the context of institutional governance,it faces triple-dimension security risks of individuals,the public and the country.Behind the risks is the tension between the two values of data security and data utilization.The integration and conflict between the two values constitute the main line running through the ICV regulation system,in which the imbalance and lack of value control are frequently reflected.The attribute of data security,different from that of traditional security,determines the possibility of unification of the two values.From the perspective of a holistic approach to national security,the normative construction of the principal purposes and main aspects of data security can realize the balance of conflicting values and effective and safe use of data by three approaches of taking the value of"people's security"as the bottom line,the compatibility with the development level as the evaluation standard,and focusing on the core conflicts as the evaluation method.
