基于CiteSpace的数据产权研究现状与趋势分析

Status and trends of data property rights:a visual analysis using CiteSpace

为构建我国数据产权研究的科学体系,服务司法实务之发展,运用CiteSpace可视化软件,分析1986—2023年期间中国知网数据库收录的关于数据产权的期刊论文,对数据产权研究领域进行历史的全景扫描。研究发现:数据产权是一个多学科、多视角的综合性研究领域,法学、计算机以及经济学等学科占据主流地位;研究趋势上,我国数据产权研究从2017年开始进入大幅增长期,受政策影响较大,具有沿着“隐私权”到“数据权利”又向“数据产权”推进的发展历程;研究议题上,旨在解决保护、交易、确权、治理、冲突协调等问题;研究客体上,当前学界对个人数据和商业数据的研究较多,对公共数据及科学数据的关注较少;研究转向上,应加强对数据产权的基础理论研究,促进多学科协同合作,推进多方协同视角下对数据产权保护制度建构路径的学术探讨。

To provide decision-making references for building a scientific system of data property rights research and serving the development of judicial practice,this study utilizes the CNKI database to analyze literature on data property rights from 1986 to 2022.By employing CiteSpace visualization software,we conduct a historical panoramic scan of the data property rights research field and analyze the evolution of research themes across different stages.Our findings reveal that the study of data property rights can be integrated into a multidisciplinary research field encompassing law,computer science,and economics.The research trend in this field has transitioned from focusing on“privacy”to“data rights”and further to“data property”,significantly influenced by national policies.Research topics aim to address issues related to protection,transactions,identification,governance,and conflict resolution.However,comparatively less attention has been given to public data and scientific data,with more emphasis on personal and commercial data.Future research should focus on strengthening basic theoretical research on data property rights,promoting multidisciplinary cooperation,and fostering academic discussions on the construction of data property rights protection from a multi-stakeholder perspective.
