除基本的欧洲专利公约(以下简称EPC)及其实施细则之外,欧洲专利局(以下简称EPO)上诉委员会判例法通过不断充实的上诉案例的审理过程和结果,动态、微观地体现EPO对于审查标准的调整和变更,展现了EPO对涉及商业方法专利申请的保护发展的历程。文章通过对一些经典判例的分析,展现欧洲对于商业方法审查模式的发展过程。

In addition to the basic European Patent Conventions(EPC) and Rules,the Case Law of the Boards of Appeal of the European Patent Office(EPO) dynamically and microscopically reflects the adjustment and change of EPO's examination standards through the continuously enriched trial process and results of appeal cases,and shows the development process of EPO's protection of patent applications involving business methods.Through the analysis of some classic cases,it shows the development process of the business method review model in Europe.
