智能算法的专利保护进路

The Approach to Patent Protection of Intelligent Algorithm

智能化时代下,智能算法日益成为科技革新和社会进步的重要力量。建构智能算法的知识产权保护体系是适应智能社会的必由之路。专利法“公开换保护”的机制既能保证算法开发者对自身权利的保护,激发其持续创新活力,又能在一定程度上防范算法歧视等社会风险。智能算法兼具技术方案和思维规则的双重属性,不同于纯粹的智力活动规则,具备可专利性,应作为专利法的保护客体。在此基础上,实践中可结合智能算法特征,以专利审查的三大实质要件对智能算法进行具体判断,以期激励算法技术创新,推动智能社会的稳健发展。

In the era of artificial intelligence,intelligent algorithm has increasingly become an important force for scientific and technological innovation and social progress.Building intellectual property protection system of intelligent algorithm is the best way to adapt to intelligent society.The mechanism of"public exchange for protection"in patent law can not only guarantee the protection of algorithm developers'rights to stimulate their continuous innovation vitality,but also prevent social risks such as algorithm discrimination.Intelligent algorithm has the dual attributes of both technical scheme and thinking rules which is different from pure intellectual activity rules.So intelligent algorithm is patentable and should be the object of protection in patent law.On this basis,in practice,combined with the characteristics of intelligent algorithm,we can make a specific judgment of intelligent algorithm according to the three essential elements of patent examination,in order to stimulate the technological innovation of algorithm and promote the steady development of intelligent society.
