利用虚拟货币转移涉诈资金犯罪侦查研究

Research on Investigating Crimes Involving Fraudulent Funds Transferred through Virtual Currency

近年来,虚拟货币犯罪形势严峻,利用虚拟货币转移涉诈资金犯罪呈现高发态势,并初步形成了虚拟货币洗钱产业链。目前该类案件的侦办存在币流追踪、溯源难,身份关联、证实难,证据收集、调取难,赃款追缴、处置难四大侦查难点。为有效地打击利用虚拟货币转移涉诈资金犯罪,侦查机关应当从警企协作、数据研判、证据引领、机制探索四个方面出发,共建虚拟货币币流追踪系统,汇集虚拟货币“去匿名化”大数据资源,加强预警监测机制研发,同时加强专业队伍建设,创新案件取证思路,制定案件侦查指引,健全境外协查调证及冻结扣押机制,完善涉案虚拟资产处置制度。

In recent years,the situation of virtual currency crimes has become severe,with an increasing trend of using virtual currency to transfer fraudulent funds,which has led to the emergence of a virtual currency money laundering industry chain.Currently,investigating such cases faces four major challenges:difficulty in tracking and tracing the flow of virtual currency,difficulty in establishing identity relationships and confirming identities,challenges in collecting and retrieving evidence,and difficulties in recovering and disposing of illicit funds.In order to effectively combat crimes involving the transfer of fraudulent funds through virtual currency,investigative agencies should focus on four aspects:police-enterprise cooperation,data analysis and judgment,evidence-led investigations,and mechanism exploration.This includes building a system for tracking the flow of virtual currency,gathering large-scale data resources for"deanonymizing"virtual currencies,strengthening the development of early warning and monitoring mechanisms,enhancing the professionalism of investigative teams,innovating approaches to evidence collection,formulating investigation guidelines for cases,improving mechanisms for international cooperation,evidence preservation,freezing,and asset disposal related to virtual assets involved in cases.
