总体国家安全观视角下我国数据出境安全管理制度的完善

Perfection of China's Data Exit Security Management System from the Perspective of Overall National Security Concept

随着信息技术的迅猛发展,数据跨境流动日益频繁。在这种背景下,数据出境带来的国家安全风险也日益凸显,对我国国家安全构成了严重威胁。从总体国家安全观视角出发,数据安全与国家安全都是一种系统化风险,牵一发而动全身,需要引起高度重视。当前,我国数据出境安全管理制度尚不完善,数据出境安全管理制度的国际合作与协调机制尚存不足,因而亟需完善相关制度,以确保数据安全和国家安全。完善我国数据出境安全管理制度,要加强我国数据出境法律法规的制定与修订,健全数据出境的审批与监管机制,推动数据出境管理的跨部门协同治理,增强数据跨境流动的国际合作与协调。

With the rapid development of information technology,the cross-border flow of data is becoming more and more frequent.In this context,the national security risks brought by data leaving the country are increasingly prominent,posing a serious threat to China's national security.From the perspective of the overall national security concept,data security and national security are both systematic risks,which need to be highly valued.At present,China's data exit security management system is not perfect,and the international cooperation and coordination mechanism of data exit security management system is still insufficient,so it is urgent to improve the data exit security management system to ensure data security and national security.To improve China's data exit security management system,we should strengthen the formulation and revision of China's data exit laws and regulations,improve the approval and supervision mechanism of data exit,promote cross-departmental collaborative governance of data exit management,and enhance international cooperation and coordination of cross-border data flow.
