刑事一体化视野下网络暴力的规制模式

Research on the Regulatory Model of Cyber Violence from the Perspective of Criminal Integration

面对网络暴力的滋生蔓延态势,有关治理对策接续推出,治理手段不断优化。刑法规制是网络暴力治理的重要手段之一。然而,侮辱罪、诽谤罪等相关罪名的适用在具体追诉程序之中陷入困境,使得权益保障的功能未能得以充分发挥。基于此,最高人民法院、最高人民检察院、公安部正在制定的惩治网络暴力专门规范性文件,坚持刑事一体化的理念,将畅通刑事追诉程序作为网络暴力刑事治理的破题之举。基于刑事一体化视角溯源观察可以发现,宜将网络暴力的治理重心由事后追责转向事前防范和事中救济,着力建构长效机制。对此,要通过推进《反网络暴力法》的制定和配套刑法规定的修改完善,实现对网络暴力的标本兼治。

Facing the growth and spread of cyber violence,relevant governance countermeasures have been introduced one after another,and governance methods have been continuously optimized.Criminal law regulation is one of the important means of cyber violence governance.However,the application of crimes of insult,defamation and other related crimes is in a dilemma in the specific prosecution procedures,which makes the function of protecting rights and interests unable to be fully utilized.Based on this,the Supreme People's Court,the Supreme People's Procuratorate and the Ministry of Public Security are in the process of making special regulations for punishing cyber-violence,adheres to the concept of criminal integration,and regards smooth criminal prosecution procedures as a breakthrough in the governance of cyber-violence.From the perspective of criminal integration,it can be found that the focus of cyber violence governance should be shifted from post-event accountability to pre-event prevention and relief during the event,and efforts should be made to build a long-term mechanism.In this regard,it is necessary to promote the formulation of the"Anti-Internet Violence Law"and the revision and improvement of supporting criminal law provisions to achieve both symptoms and root causes of cyber violence.
