Practice and Exploration of Legalization of Labor Security in New Forms of Employment

随着互联网数字技术的进步,新就业形态对促进就业产生了积极效应,新就业形态劳动者权益保障也成为法制化探索的起点,对当前劳动保障政策带来新的挑战。党的十八大以来,新就业形态在国家规范指导下健康发展,自2018年以来,政府从战略顶层设计上推动新就业形态整体协同发展,工作重心进一步突出劳动保障政策制度创新改革。新就业形态劳动者,特别是不完全劳动关系劳动者,因其劳动关系认定基准问题基本权益难以得到切实保障。当前,在充分把握新就业形态发展趋势的基础上,应加深不完全劳动关系法律规制研究。在此基础上,短期聚焦劳动者权益保障的突出问题如职业伤害保障,长期把握社保领域与就业领域之间改革的联系,深入落实劳动者权益保障问题。在就业优先战略引领下,统筹谋划形成政策合力,加快新就业形态劳动保障法制建设,全力确保就业局势总体稳定。

With the progress of Internet digital technology,new forms of employment have a positive effect on promoting employment,and the protection of labor’s rights and interests in new forms of employment has also become the starting point of legal exploration,bringing new challenges to the current labor security policy.Since the 18th National Congress of the Communist Party of China,new forms of employment have developed healthily under the guidance of national norms.Since 2018,the government has promoted the overall coordinated development of new forms of employment from the strategic top-level design,and further highlighted the innovation and reform of labor security policies and systems.The basic rights and interests of workers with new employment forms,especially those with incomplete labor relations,are difficult to be effectively protected because of the identification basis of labor relations.At present,on the basis of fully grasping the development trend of new employment forms,we should deepen the research on the legal regulation of incomplete labor relations.On this basis,in the short term,we will focus on the prominent problems of the protection of labor’s rights and interests,such as occupational injury protection.In the long term,we will grasp the connection between the reform of social security and employment,and further implement the protection of labor’s rights and interests.Under the guidance of the employment-first strategy,we will make coordinated plans to form policy synergy,accelerate the development of a legal system for labor security for new forms of employment,and do our best to ensure overall stability in employment.
