“双碳”目标下《黑土地保护法》的立法意义与规范完善

Reconstruction and Improvement of the Legislative Purpose of Black Soil Protection Law under the Goal of'Double Carbon'

《中华人民共和国黑土地保护法》于2022年8月1日起正式施行,该法的颁布具有重要的理论和实践意义。但立法目的条款中缺失对中国当下“双碳”目标的回应,忽略了黑土地巨大的碳汇能力,无法满足公众对于黑土地保护法的价值企盼,应进行立法目的条款重构并进一步完善具体法律规范,将“提升黑土地碳汇能力”增添到《黑土地保护法》的立法目的条款中。同时,黑土地的碳汇能力应当成为判断黑土地科学分区的指标之一,并编入调查和监测体系,作为黑土地质量评判要素,并落实修复质量制度。

Black Soil Protection Law of China has been promulgated and implemented.The pro mulgation of this law has both theoretical and practical significance.However,the legislative purpose clause lacks China's current response to the pursuit of the'dual carbon'goal,neglects the huge carbon sequestration capacity of black land and is unable to meet the value expectations of the black land protection law.Therefore,the legislative purpose clause should be restructured and specific legal norms should be improved.We should add'enhancing the carbon sequestration capacity of black land'to the legislative purpose clause of the Black Soil Protection Law.At the same time,the carbon sequestration capacity of black soil should become one of the indicators for determining the scientific zoning of black soil,and be incorporated into the investigation and monitoring system,become an element of black soil quality and its evaluation,and implement a restoration quality system.
