摘要
有效解决新就业形态劳动者的职业伤害问题,不仅关系劳动者的权益维护和平台经济的健康发展,而且关系工伤保障制度的完善。一些地区自行开展了职业伤害保障试点,为建立统一的新就业形态劳动者职业伤害保障制度提供了经验与启示。新就业形态劳动者职业伤害保障制度需要从制度属性、筹资机制与基金管理、职业伤害确认、经办服务与管理、职业伤害保障待遇等方面构建。与此同时,应加强顶层设计,适时修改《中华人民共和国社会保险法》和《工伤保险条例》,为新就业形态劳动者筑起坚实的职业伤害保障。
Effectively addressing the occupational injury protection issues of employees in new forms of employment concerns not only the workers'rights and the healthy development of platform economy,but also the improvement of the work-related injury insurance system.In some regions,certain pilot programs for occupational injury protection have been put into practice,which provides experiences and insights for a unified occupational injury protection system for the employees of new forms of employment.This system needs to be designated with considering various factors including institutional attributes,funding mechanisms and fund management,identification of occupational injury,service provision and management,as well as occupational injury protection.Meanwhile,to achieve occupational injury protection to workers in new forms of employment,top-level design should be strengthened with amending the Social Insurance Law of the People's Republic of China and the Regulations on Work-related Injury Insurance.
