论现代化国家治理体系下的检察公益诉讼

On Prosecutorial Public Interest Litigation under the Modern National Governance System

检察公益诉讼是学者们在公益保护领域长期以来理论研究的指向,是十八届四中全会以来在司法制度领域全面深化改革探索的成果。在国家法治现代化进程中,国家权力体系逐渐发生改变,检察机关通过提起公益诉讼保护整体性利益这一模式已经得到广泛认可。而在立法和理论研究层面,检察机关提起公益诉讼却面临着法制基础不足、权能性质不明确等重大问题,因此对检察公益诉讼的职能进行准确定位具有其现实意义。文章试从经济发展的角度论证检察公益诉权对实现公共利益协同治理的重要性,从法律监督的角度论证检察公益诉权在社会公共利益保护领域对公权力实现有效制约的重要性,旨在通过明确检察公益诉讼在现代化国家治理体系下的宏观定位,为检察公益诉讼制度的改革和发展奠定基础和树立航标。

Prosecutorial public interest litigation is a long-term theoretical research direction of scholars in the field of public interest protection,and it is the result of comprehensive deepening of reform and exploration in the field of judicial system since the Fourth Plenary Session of the 18th Central Committee.In the process of the modernization of the country’s rule of law,the national power system has gradually changed,and the procuratorial organ’s model of protecting the overall interests through public interest litigation has been widely recognized.At the legislative and theoretical research levels,procuratorial organs face significant issues such as insufficient legal foundation and unclear nature of power when filing public interest litigation.Therefore,accurately positioning the functions of procuratorial public interest litigation has practical significance.This paper tries to demonstrate the importance of procuratorial public interest litigation right to achieve coordinated governance of public interests from the perspective of economic development,and demonstrate the importance of procuratorial public interest litigation right to achieve effective restriction of public power in the field of social public interest protection from the perspective of legal supervision,aiming to lay the foundation and establish navigation marks for the reform and development of procuratorial public interest litigation system by clarifying the macro positioning of procuratorial public interest litigation under the modern national governance system.
