企业刑事合规本土化现实困境与路径匡正

近年来,关于保障民营企业发展的呼声愈发高涨,针对实践中存在“办一个案子,垮一个厂子”的司法现象,开展企业刑事合规具有现实紧迫性。对完成合规计划、通过合规考验的涉案企业作出不起诉决定,不仅可以挽救企业,也可以避免社会震荡。在最高人民检察院的主导下,企业刑事合规改革试点在全国如火如荼铺开,取得良好社会效果的同时在法律衔接、合规适用对象、部门协作等方面还存在诸多现实困境,应通过完善法律供给、发展多元化适用对象、加强部门联动等路径予以匡正。

In recent years,the requirements of ensuring the development of private enterprises is rising.In view of the judicial phenomenon of“handling a case and breaking a factory”in practice,it is urgent to carry out criminal compliance of enterprises.Making a non-prosecution decision for the enterprises in⁃volved in the completion of the compliance plan and passing the compliance test can not only save the enterprise,but also avoid social unrest.Under the leadership of the Supreme People’s Procuratorate,the pi⁃lot reform of corporate criminal compliance is in full swing across the country.Although achieving good social effects,there are still many practical difficulties in legal convergence,compliance applicable objects,and departmental collaboration.Therefore,it should be corrected by improving legal supply,developing di⁃versified applicable objects,and strengthening departmental linkage.
