新时代“枫桥经验”的研究不应仅局限于理论层面,更应对案例进行实证研究。研究发现枫桥经验在司法案例中存在案件数量少、笼统运用而不进行论证说理、鲜有法官主动提出等不足。枫桥经验的案例包括基层个案和司法个案。案例化研究不仅能够将抽象的枫桥经验具体化,还能够采取新的视角学习枫桥经验,提升枫桥经验的影响力。通过案例的选取、编撰、发布、传播、适用等环节,将基层治理中个案的路径研究和司法个案的焦点问题相结合。既能够从实践层面反哺枫桥经验的理论研究,也能够深化枫桥经验的实践内涵。推动新时代“枫桥经验”深层次、多元化发展。

The study of Fengqiao experience in the new era should not only be limited to the theoretical level,but also should be an empirical study of cases.It is found that Fengqiao experience has some shortcomings in judicial cases,such as a small number of cases,general application without reasoning,and rarely proposed by judges.The cases of Fengqiao's experience include grassroots cases and judicial cases.The case study can not only concretize the abstract Fengqiao experience,but also take a new perspective to learn Fengqiao experience and enhance the influence of Fengqiao experience.Through the selection,compilation,publication,dissemination and application of cases,the path study of grassroots governance cases and the focus of judicial cases are combined.It can not only feed the theoretical research of Fengqiao experience from the practical level,but also deepen the practical connotation of Fengqiao experience.Promote the deep and diversified development of Fengqiao experience in the new era.
