大气污染行政处罚案件生态环境损害鉴定评估研究

行政处罚案件是生态环境损害赔偿案件的重要线索来源之一,涉及大气污染的行政处罚案件占比非常高,追究当事人的生态环境损害赔偿责任的关键是进行生态环境损害鉴定评估。文章通过分析大气污染行政处罚案件特点,总结此类案件开展生态环境损害鉴定评估存在的问题及不足,提出开发生态环境损害鉴定评估的建议措施,同时通过两个大气行政处罚案例进行鉴定实践,取得较好的应用成效,对开展大气生态环境损害案件鉴定评估具有重要指导作用。

Administrative penalty cases are one of the important sources of clues for ecological environment damage compensation cases.The proportion of administrative penalty cases involving air pollution is very high.The key to holding the parties responsible for ecological environment damage compensation is to conduct ecological environment damage appraisal and evaluation.This article analyzes the characteristics of air pollution administrative penalty cases,summarizes the problems and shortcomings in conducting ecological environment damage identification and assessment in such cases.It also proposes suggestions and measures for developing ecological environment damage identification and assessment.At the same time,two atmospheric administrative penalty cases are used for identification and practice,achieving good application results,which has an important guiding role in conducting atmospheric ecological environment damage case identification and assessment.
