生态文明建设地方立法比较研究

Comparative Analysis of Local Legislations on Building an Ecological Civilization

基于17件生态文明建设地方立法,比较分析了立法名称、适用范围、立法框架和内容,分析发现:多数地方的生态文明建设立法细化本级人民政府生态文明建设职责,推进生态文明制度法治化,明确国家机关及其工作人员在生态文明建设中的法律责任。与省级立法相比,市级立法对法律责任的规定更加具体。针对不足之处,提出完善的初步设想,建议在生态文明建设立法制修订时,遵循生态文明体系设置立法框架,增加以保障生态安全为目的的相关条款,将切实可行的本地探索与实践经验上升为法规条款。

This paper compared and analyzed the name,scope of application,legislative framework and content of seventeen local legislations on building an ecological civilization.The main conclusions were as follows:The most of local legislations clarified responsibilities for building an ecological civilization of local government at the same level,promoted the legalization of the system of institutions for building an ecological civilization,and clarified the legal responsibilities of state organs and their staff.Compared with provincial regulations,municipal regulations had more specific provisions on legal liability.In view of the shortcomings,this paper gave some proposals.When making or revising the local legislation on building an ecological civilization,it could be followed the system for ecological civilization to set up the legislative framework.It was necessary to add relevant provisions for the purpose of ensuring ecological safety.The practical local exploration and experience could be set as regulatory provisions.
