2022年3月,国家互联网信息办公室就《未成年人网络保护条例(征求意见稿)》,再次向公众征求意见,并专门设置第四章对未成年人个人信息的保护进行了专门规定和详细阐述,提炼和归纳了现行有效的相关条款,满足了未成年人个人信息保护的现实需求,拉开了我国对未成年人个人信息保护的序幕。但是,现行未成年人个人信息保护仍存在着规范之间的适用冲突、个人敏感信息界限不明、知情同意制度形同虚设等问题,并未充分贯彻“赋权与保护”原则。针对潜在风险,我们应当在坚持统分结合的立法模式下,以《未成年人网络保护条例(征求意见稿)》为蓝本,结合未成年人的身心发展状况合理界定敏感个人信息范围,对信息处理者获取知情同意权的方式进行具体的规制,并试图以诉讼代理制度弥补监护人制度的不足,以期更全面地维护未成年人的个人信息权益。
