个人信息保护的劳动基准立法探析

摘要 数字科技的发展使劳动者的个人信息安全问题日益凸显,而我国目前的个人信息保护立法缺乏对劳动者的倾斜性保护,劳动法体系中也欠缺将个人信息安全作为数字时代必要劳动条件的认识,鉴于基本劳动标准立法已纳入立法规划,此时通过劳动基准法实现对劳动者的个人信息保护具有必要性。劳动基准法的底线性、法定性和强制性指出了作为劳动基准的个人信息保护在一定范围内具有可行性,而不宜设置过高的标准,在此基础之上进一步提出限缩个人信息处理规则、分级处理方案以及劳动监察保障等立法建议。 The development of digital technology has brought the issue of workers'personal information security to the forefront,and the current legislation on personal information protection in China lacks inclined protection for workers,and the labor law system also lacks the understanding of personal information security as a necessary labor condition in the digital age.Given that the legislation on basic labor standards has been incorporated into the legislative plan,it is necessary to realize the protection of workers'personal information through the Labor Standards Law at this time.The basic labor standards legislation has been included in the legislative plan.The bottom-line,statutory and mandatory nature of the Labor Standards Law points out that the protection of personal information as a labor standard is feasible within a certain range,and it is not advisable to set too high a standard.On this basis,further legislative proposals are made to limit the rules of handling personal information,graded handling scheme and labor inspection guarantee.
