农村经济视角下我国个人破产制度发展路径探究

Exploring the Development Path of Chinese Personal Bankruptcy System from the Perspective of Rural Economy

如今我国经济高速发展,民营经济得到持续稳定的发展,个人面临欠债未还、资不抵债的情形也越来越多。为此,将个人破产法纳入现代破产法的组成部分显得尤为重要,体现出破产法对自然人的关怀。但个人破产制度免除的是个人所有的财物,我国土地承包制规定了农民的土地归集体所有,不属于个人,农民面临无产可破的尴尬境地。本文就我国目前农村经济制度的实际情况,探究我国个人破产制度在农村的发展,以期所有自然人得到更好的救济。

Nowadays,Chinese economy is developing at a high speed,the private economy has been sustained and stabilized,and individuals are facing more and more cases of unpaid debts and insolvency.For this reason,the personal bankruptcy law into the modern bankruptcy law component is particularly important,which reflects the bankruptcy law to the care of natural persons.However,the personal bankruptcy system is exempted from personally owned property,whereas Chinese land contract system lays down that farmers'land belongs to the collective ownership instead of the individual,making the farmers face the embarrassing situation of no production can be broken.This article based on the actual situation of Chinese current rural economic system,explores the development of Chinese personal bankruptcy system in rural areas,with a view to all natural persons to get a better relief.
