区块链赋能西部地区“双碳”目标的实现机理及法治理路

The Realization Mechanism of Carbon Peaking and Carbon Neutrality Goals Energized by Block Chain and the Way of Law Administration in the West Region

碳达峰、碳中和目标的提出,为西部地区利用资源禀赋加快发展新能源带来机遇。我国西部地区有丰富的自然资源,碳达峰、碳中和是制约碳排放的可行目标,对该区域的可持续发展有着积极意义。但西部地区想要实现“双碳”目标任务异常艰巨,能源结构不平衡、低碳化程度不高、利用效率低,以及统一的碳交易市场还未建立而导致的区域发展不协调等问题突出。作为限额和交易系统的支柱,区块链可以凭借其独特的优势分散能源市场,为国际气候变化协议提供更强大的框架,赋能碳交易和产业转型升级,为我国实现“双碳”目标提供有力的技术支撑。但区块链仅仅是实现“双碳”目标的助推器,并不能提供足以替代甚至超越传统法律的治理框架,仍需要法律和监管的介入,进而实现法律与区块链的共存共荣。

The proposal of carbon dioxide emission peaking and carbon neutrality targets brings new opportunities for the western region to accelerate the development of new energy by utilizing the resource endowment.There are abundant natural resources in the western region of China.The carbon dioxide emission peaking and carbon neutrality are feasible targets for restricting carbon emission,which have positive significance for sustainable development in this region.However,due to the imbalance of energy structure,low degree of low carbonization,inefficiency of utilization,and the uncoordinated regional development caused by the lack of a unified carbon trading market,the western region has extremely difficult task to achieve the“double carbon”target.As the backbone of a cap-and-trade system,block chain can decentralize the energy market with its unique advantages,provide a stronger framework for international climate change agreements,energize the carbon trading and the transformation and upgrading of industry,and provide strong technical support to achieve the“double carbon”goal in China.But the block chain is only a booster to achieve the“double carbon”goal,and it can't provide a governance framework that can replace or even surpass the traditional law.It still needs legal and regulatory intervention to achieve the coexistence and prosperity of the law and the block chain.
