建构国家教育考试应急法的价值因应及法理逻辑

The Value Response and Legal Logic of Constructing the Emergency Rule of Law for National Education Examinations

从价值嬗变上讲,国家教育考试应急法治具有制度完善、教育法治和提质增速三重功能。从实践来看,国家教育考试应急管理法律制度资源供给不足、已有立法位阶不高、制定和发布主体不统一、应急处置机制和监督机制不健全等问题亟须解决。面对这些困境,基于全贯通式建构的法理逻辑,通过完善国家教育考试应急管理实定法体系,优化国家教育考试应急管理执法体系和应急管理监督体系,建立由实定法体系、执法体系和监督体系共同构成的国家教育考试应急法治体系,以期对教育治理体系和治理能力现代化建设有所裨益。

From the perspective of value evolution,the emergency rule of law for national education exams has three functions:institutional improvement,education rule of law,and improving quality and growth rate.From a practical perspective,there is an urgent need to address issues such as insufficient supply of legal resources for emergency management of national education exams,low level of existing legislation,inconsistent formulation and release bodies,and inadequate emergency response and supervision mechanisms.Faced with these difficulties,based on the legal logic of a comprehensive construction,by improving the practical legal system for emergency management of national education exams,optimizing the law enforcement system for emergency management of national education exams,and improving the supervision system for emergency management of national education exams,a national education exam emergency legal system composed of practical legal system,enforcement system,and supervision system is established,In order to benefit the modernization of the education governance system and governance capacity.
