新型网络犯罪治理体系化研究

Research on the Systemization of New Cybercrime Governance

当前以网络黑灰产为代表的新型网络犯罪高发频发、手法不断翻新、跨境作案突出,给网络空间治理带来了巨大挑战。新型网络犯罪具有明显的社会化分工、产业化链条和积量构罪特征,导致侦查取证、法律适用、行业监管和社会预防工作面临重重困难。建议在立法层面织密网络安全监管法网、完善刑事法律规制体系,在监管层面完善体制机制、推进行业整治、筑牢技术屏障,在打击层面强化行刑衔接、办案协同协作、提高专业能力,在预防方面督促企业责任落实、强化行业协同自律、提高群众防范意识,通过系统治理、综合施策,有效规制新型网络犯罪,共建网络安全生态。

Nowadays,new cybercrime,represented by online black and gray industries,is on high rise,its methodology constantly evolves and it has obvious cross-border characteristics,thus bringing about great challenges to the policing of cyberspace.The new cybercrime has obvious characteristics of socialized work division,industrial chains,and recidivism structure,which contributes to difficulties in investigation and evidence collection,law application,industrial supervision and social prevention and control.Suggestions have been made that we should strengthen the supervision of web security and improve the criminal legal regulation systems in terms of legislation.We should improve institutional mechanisms,promote industrial rectification and build a solid technical barriers in terms of monitoring.In terms of combat,we should reinforce the links between civil law and criminal law,cooperation in trying cases,and improve professional competency.In terms of prevention and control,we should strengthen corporate self-discipline,and public awareness of prevention.Only by systematic governance and taking various measures can we finally control new cybercrime effectiveland and jointly create a cybersecurity ecosystem.
