The Present Situation,Plights and Countermeasures Concerning the System of“Proposing to Stop the Execution of Detention”

“建议停止执行拘留”制度的制订,是为保障被拘留人健康权与拘留所拘押安全管理的一项重要举措。党的二十大之后,为深入贯彻人权法治思想,保障被拘留人权益,公安部监所管理局提出要根据新修订的行政处罚法变化特点,对“建议停止执行拘留”制度执行细则进一步完善,切实体现制度设计的公平正义理念,确保制度执行的政治效果、社会效果与法律效果。在以往“建议停止执行拘留”制度执行过程中,存在停止执行条件认定周期与拘留所收拘执行之间的时效冲突,健康权益与拘押安全之间的关联风险,自由裁量与执法公平之间难以平衡,建议停止与决定停止之间的权责认定等执法难点。为进一步加强拘留所被拘留人健康权保障,破解公安基层“建议停止执行拘留”制度执行的难题,有必要根据制度设计执法流程、适用条件认定规则、被拘留人健康权保障与执法风险等方面开展对策研究。

The establishment of the system of"Suggesting Suspending Execution of Detention"is an important measure to protect detainees'health rights and to ensure the safe management of detention centers.After the 2Oth Party Congress,in order to thoroughly implement the conceptions about human rights,law governance and the protection of detainees'rights and interests,and according to the changes brought about by the newly revised Administrative Punishment Law,the Prison Administration Bureau of the Public Security Ministry suggested perfecting the details of implementing the system of"Suggesting Suspending the Execution of Detention"so as to effectively show the fairness and justice concept in designing the system,and to ensure the political,social and legal effects of implementing the system.In the past process of implementing the"Suggested Suspension of Detention"system,there were some difficulties such as time conflict between identification of the conditions for suspension of execution and the execution of detention,risks relating health rights with detention safety,the difficult balance between discretion and law enforcement justice,and the identification of powers and responsibilities between the recommendation of suspension and the decision to stop.In order to further strengthen the protection of detainees'health rights in detention centers and solve the problems in first-line police agencies'implementing the system of"suggesting stopping the execution of detention",it is necessary to conduct research into countermeasures concerning the law enforcement process design for the system,the rules for determining the applicable conditions,the protection of the detainees'health rights and law enforcementrisks.
