规范体系及其社会规范的研究价值和意义

On The Value and Significance of the Study of Normative System and Its Social Norms

法律体系是一个有着严格要求的规则体系。在我国,能够纳入法律体系的,必须符合我国《立法法》对于法律形式的要求,即必须由有立法权的国家立法机关制定,才能进入法律体系的序列,成为法律体系的组成部分。法律体系的这种严格性,必然带来其局限性。在法律之外,还有各种各样的规范类型和体系存在,且发挥着重要的作用,而我们没有办法把这些规范类型和体系都纳入法律体系中。因此,我们需要寻找一个新的命题、新的概念或新的范畴,把这些规范类型和体系纳入其框架之内。规范体系就是这样一个合适的、恰当的命题、概念和范畴。在规范体系概念之下,所有的规范类型和体系都可以纳入其中,它具有很强的包容性。在规范体系内部,存在非常复杂的相互关系,对这些复杂关系的研究和厘清,不仅有重要的理论和学术价值,也对于法治实践有重要的指导意义。

Legal system is a system of rules with strict requirements.In our country,those that can be included in the legal system must meet the requirements for the form of law set forth in the Legislation Law of the Peoples Republic of China(hereinafter referred to as the Legislation Law);that is to say,they must be formulated by the national legislature with legislative power before they can be included into the sequence of the legal system and become part of it.This strictness of the legal system is bound to bring its limitations.Outside the law,there are various normative types and systems that exist and play an important role,but we have no way to incorporate all of them into the legal system.Therefore,we need to find a new proposition,a new concept,or a new category that can incorporate all these normative types and systems into such a framework.The“normative system”is a suitable and appropriate new proposition,new concept and new category.Under the concept of“normative system”,all types and systems can be included,and it has a strong inclusiveness.Within the“normative system”,there exist very complicated interrelationships.The research and clarification of these complex relationships not only have important theoretical and academic value,but also have great guiding significance for the practice of rule of law.
