迈向新文科的法学教育范式三重定向

摘要 面向新文科的法学教育范式创新分别指向话语体系、学科体系、知识体系和人才体系的复杂变革,表征为价值性、科学性与融合性三重定向。价值性定向主要是完成价值秩序和话语体系塑造的目标,着眼于如何构建当代全球秩序安全稳健发展的价值准则,提炼以人民为中心的法治正当性价值准则以及贯彻中国特色社会主义法治道路的法价值体系。科学性定向聚焦于如何面向中国、面向发展、面向世界、面向未来集成和深化法学知识体系,关系到法学教育创新的知识论问题。融合性定向则从形式上体现出新文科对于学科结构、方法思维等人才培养体系的创新要求,推进问题导向的科际整合和以集群化学科、融合性方法解决特定问题的功能优化。面对这些新的体系变革需求,中国法学教育范式转型应从宏观层面强化价值引领,从中观层面科学构建现代法学教育的主体内容,从微观层面系统精细地落实法学教育改革新举措。 The innovation of legal education paradigm towards the new liberal arts points to the complex reform of the discourse system,the knowledge system and talent cultivation system respectively.It is represented by the triple orientations of value,scientificity and convergence.The orientation of value is mainly to achieve the goal of building value order and discourse system,focusing on how to construct the value criterion of the orderly development of the global,refining the people-centered rule-of-law values and the value criterion of the road of socialism with Chinese characteristics.The orientation of scientificity focuses on how to integrate and deepen the legal knowledge system that suits China,the world,the development and the future,which is related to the innovation of the knowledge and the theory of legal education.The orientation of convergence the innovative requirements of the new liberal arts for the discipline structure,method of thinking and talent cultivation system,which promotes problem-oriented discipline integration and functional optimization to solve specific problems by bundling disciplines and convergence methods.Facing the needs of the reforms in the systems,the paradigm transformation of Chinese legal education should include three multiple changes:at the macro level,the guidance of socialist values should be strengthened;at the intermediate level,the primary content of contemporary legal education should be established scientifically;and at the micro level,the new measures that matches and supports legal education reform should be carried out systematically and carefully.
